Terms of Service | Deep Sky Flight Training

1. Agreement to Terms

By accessing our website and using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use the services of Deep Sky Flight LLC, doing business as Deep Sky Flight Training.

2. Flight Training Services

Deep Sky Flight Training provides flight instruction in accordance with Federal Aviation Administration (FAA) regulations (Part 61). Our services include discovery flights, sport pilot certification, private pilot certification, instrument rating, commercial pilot certification, and certified flight instructor (CFI) training. Completion of training requires student dedication, study, and aptitude. We do not guarantee the issuance of any pilot certificate or rating within a specific timeframe or cost.

3. Scheduling and Cancellations

Flight slots are valuable. We require at least 24 hours notice for cancellations. Cancellations made with less than 24 hours notice may be subject to a cancellation fee equivalent to 1 hour of instructor time. Weather-related cancellations are at the sole discretion of the instructor and are not subject to fees.

4. Medical and Legal Requirements

Students are responsible for obtaining necessary FAA medical certificates and complying with Transportation Security Administration (TSA) citizenship verification requirements prior to commencing flight training involved in a new rating.

5. Liability

Aviation involves inherent risks. While we prioritize safety above all else, students participate in flight training at their own risk. Students will be required to sign a liability waiver prior to their first flight lesson. Deep Sky Flight LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

6. Payment Terms

Payment is due at the time of service. Block rates or account balances are non-refundable but may be transferred to another student upon approval. Prices for aircraft rental and instruction are subject to change due to fuel costs and other factors. Financing may be available through our partner, Flight Training Finance LLC.

7. SMS Communications Consent

Deep Sky Flight LLC, doing business as Deep Sky Flight Training, may send SMS/text messages to customers and prospective customers who provide their phone number through our website contact form.

Consent Is Always Optional

Consent checkboxes on our contact form are always optional and are not required to submit the form or to purchase any goods or services. You may submit our contact form without checking any SMS consent box.

Two Types of Messages

We offer two separate categories of text messages you may opt in to:

Non-Marketing Messages: These include appointment follow-ups, weather advisories affecting scheduled flights, and training schedule updates.
Marketing Messages: These include special offers, discounts, and service updates to promote our flight training programs and services.

Message Frequency and Rates

Message frequency may vary. Message and data rates may apply.

Opt-Out and Help

Condition of Service

Consent to receive marketing or non-marketing text messages is not a condition of purchasing any goods or services from Deep Sky Flight Training.

Third-Party Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support of SMS delivery services (such as customer service platforms) is permitted solely for the purpose of transmitting your messages.

Opt-In Data Protection

All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carrier Liability

Carriers (including but not limited to T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages. Deep Sky Flight LLC is not responsible for any charges assessed by your mobile carrier in connection with text messages you receive from us.

Age Restriction

You must be at least 18 years of age or have obtained parental or guardian consent to opt in to our SMS messaging program and use our services. By submitting the contact form, you represent that you meet this age requirement.

Privacy

Your use of our SMS services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including mobile phone numbers and opt-in data.

8. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to this page. Your continued use of our services after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
